1. Applicable Conditions
1.1
These terms and conditions of sale (“Terms and Conditions”) apply to all purchases made by customers (“Customer(s)”) on our webshop www.aestheticspharma.shop. The webshop is owned and operated by Aesthetics Pharma Shop (“Aesthetics Pharma Shop”, “we”, “us”, “our”).
1.2
All products sold by us through our webshop are covered by these Terms and Conditions, including but not limited to cosmetics, medical devices, pharmaceuticals, parapharmaceuticals and disposables (“Product(s)”).
1.3
We only sell Products to doctors, aesthetic clinics, hospitals, pharmacies and wholesalers. We do not accept orders from private individuals.
1.4
We advise you to carefully read these Terms and Conditions before placing any order on our webshop.
2. Orders
2.1
Customers may place online orders 24 hours a day on our webshop. Orders are usually processed within 48 working hours after receipt.
2.2
After placing an order, the Customer will receive an order overview by email. This does not constitute a binding order confirmation.
2.3
A binding agreement is formed when the Customer receives an email with shipment notification, invoice and packing slip (“Order Confirmation”).
2.4
Once an order is placed, it is binding for the Customer.
3. Availability of Products
3.1
We strive to ensure that all Products displayed are available, but stock cannot be guaranteed. If a Product is unavailable, we may either offer an equivalent Product or notify the Customer that we cannot fulfil the order.
3.2
If the Customer rejects the alternative Product or we cannot fulfil the order, we will refund any payment already made. This is the Customer’s sole remedy.
4. Customer Information
4.1
The Customer is responsible for ensuring that all provided information (including company details and VAT number, if applicable) is accurate.
4.2
If information is changed, we reserve the right to verify and re-approve the Customer account within 72 hours.
5. Delivery and Delay
5.1
Products in stock are usually shipped the same day or the next working day. Out-of-stock items are normally shipped within 3–6 working days.
5.2
Orders are shipped via international courier services and tracking details are provided.
5.3
Maximum delivery time is 60 days from the order date.
5.4
In case of delays beyond 6 working days from confirmation, the Customer’s sole remedy is refund or credit.
5.5
We are not responsible for delivery issues caused by incorrect addresses provided by the Customer.
5.6
Warehouse pickup is not available.
6. Price and Payment
6.1
All prices displayed are exclusive of VAT, taxes, duties and delivery costs unless stated otherwise.
6.2
Prices may change at any time but will not affect confirmed orders.
6.3
In case of pricing errors, we reserve the right to cancel the order or contact the Customer for confirmation.
6.4
We are not obligated to supply Products at incorrect prices.
6.5
Full payment is required before order processing.
6.6
Payments are accepted via credit/debit cards and other payment methods displayed at checkout.
6.7
International or non-local card payments may incur additional fees.
6.8
Bank transfers are accepted upon request and may include handling fees.
6.9
We reserve the right to cancel any order if fraud is suspected.
7. Compliance with Laws and Regulations
7.1
Aesthetics Pharma Shop acts as an international wholesaler and does not guarantee compliance with local regulations in the Customer’s country.
7.2
The Customer is responsible for complying with all applicable laws related to importation, storage, resale and use of Products.
7.3
The Customer must obtain all necessary licenses, permits and approvals.
7.4
The Customer is responsible for post-market surveillance, adverse event reporting and recalls where applicable.
7.5
Any resale restrictions must be respected and passed on to subsequent buyers.
8. Defects
8.1
Products are provided “as is” without any implied warranties.
8.2
Defects must be reported in writing within 3 days of receipt.
8.3
Products must be inspected immediately upon delivery.
8.4
Our obligation is limited to repair, replacement, price reduction or refund.
8.5
We do not reimburse return shipping or handling costs.
8.6
Refunds are made to the original payment method and may take up to 29 working days.
8.7
Returned Products must be approved in writing before being sent back.
9. Products Damaged in Transit
9.1
Damage must be reported within 3 days with supporting evidence.
9.2
Claims without documentation will be rejected.
9.3
The Customer must cooperate in carrier claims.
9.4
Remedy is limited to replacement or refund.
10. Liability
10.1
Our liability is limited to the purchase price of the Products.
10.2
We are not liable for indirect or consequential losses.
10.3
Total liability shall never exceed the amount paid for the Products.
10.4
Claims must be made within 3 months of delivery.
11. Third Party Rights
11.1
We do not guarantee that Products do not infringe third-party intellectual property.
11.2
Any IP claims must be reported immediately.
12. Product Liability
12.1
We are not liable for bodily injury or property damage except where required by law.
12.2
We are not responsible for damages after delivery.
12.3
Liability is limited to the annual purchase value.
12.4
The Customer indemnifies Aesthetics Pharma Shop where applicable.
12.5
Legal claims may be filed in the same jurisdiction as third-party claims.
13. Adverse Event Reporting and Recall
13.1
Adverse events must be reported within 2 days.
13.2
Any important safety or legal issues must be communicated immediately.
13.3
Customers must assist in recalls and bear their own costs.
14. Taxes and Other Payments
14.1
The Customer is responsible for all taxes, duties and fees.
14.2
We are not liable for customs or tax charges.
14.3
We are not responsible for customs delays.
15. Force Majeure
15.1
We are not liable for delays caused by circumstances beyond our control.
16. Governing Law and Jurisdiction
16.1
These Terms are governed by the laws of the country where Aesthetics Pharma Shop is registered.
16.2
Disputes shall be settled by the competent courts of that jurisdiction.
16.3
We reserve the right to initiate legal proceedings in the Customer’s country if necessary.
